Kid Rock has filed a lawsuit against World Wide Red Light District and its president, claiming that the distribution of a video of the Detroit rock-rapper and former Creed frontman Scott Stapp having sex with four strippers violates his right to privacy and trademark rights.
A federal judge in Detroit signed a temporary restraining order against Red Light District on Tuesday that forbids it from showing a preview clip of the saucy video. The order will remain in effect until a court hearing on Friday, but Red Light District had already voluntarily removed the clip from two preview sites on February 17 after receiving a cease-and-desist letter from Stapp's lawyers.
The lawsuit seeks a permanent order prohibiting the company from selling or distributing the video.
"We don't deny the authenticity of the tape," said Rock's lawyer, William Horton, to the Detroit Free Press after obtaining the restraining order. "But they're using this without his permission to drive the sales of their other products."
In an affidavit accompanying the suit, Rock (real name Robert Ritchie) said Stapp shot the video in December 1999 on a tour bus near Miami.
"It was explicitly understood that the video would remain at all times the private property of Mr. Stapp and would not be displayed or exhibited to the public," he said.
Red Light District hasn't revealed how it obtained the clip, but it's the same company that distributed sex videos of Paris Hilton and former pro wrestler Chyna in the past. The California-based firm doesn't feel that it has done anything wrong.
"We had looked into the legal issues and felt confident that what we were doing was well within our rights," said Red Light District attorney Ray Tamaddon. "These are public figures, and the standards are different."
